INDEMNITY AND WAIVER AGREEMENT

WHEREAS the undersigned participant (“Participant”) is voluntarily participating in the Infantry Day Adventure Run (hereinafter referred to as the “Event”), organized by RunMonks and scheduled to be held on 27th October , at Aalo, Arunachal Pradesh.

WHEREAS the Organizers desire to protect themselves from any and all liabilities or claims arising out of the Participant’s involvement in the Event.

NOW, THEREFORE, the Participant agrees to the following terms and conditions, including an assumption of risk and waiver of liability, which is enforceable under the jurisdiction of the Indian legal system:

1. Assumption of Risk

The Participant acknowledges and fully understands that participation in an ultra-marathon event involves inherent risks, including but not limited to physical injury, mental exhaustion, exposure to harsh weather conditions, interactions with wildlife, dehydration, and the possibility of serious injury, disability, or death. By participating in the Event, the Participant voluntarily assumes all risks, both known and unknown, associated with the Event.

2. Medical Fitness

The Participant certifies that they are physically and medically fit to participate in the Event and have undergone all necessary medical evaluations to ensure their fitness for such strenuous activity. The Participant agrees to immediately cease participation if any physical discomfort or medical issue arises during the Event.

3. Waiver of Liability

The Participant hereby agrees to release, discharge, and hold harmless the Organizers, their directors, employees, agents, volunteers, sponsors, and any associated entities, from any and all claims, damages, demands, rights of action, or liabilities of any kind, arising out of or in connection with the Participant’s involvement in the Event. This includes, but is not limited to, injury, death, loss or damage to property, or any other incident, whether caused by negligence, conditions of the racecourse, acts of God, or any other cause.

4. Indemnity

The Participant agrees to indemnify and hold harmless the Organizers, their agents, and representatives from any claims, liabilities, damages, costs, or expenses (including legal fees) arising from or in connection with the Participant’s participation in the Event. This includes any damages caused by the Participant to third parties or the environment, including the forest and wildlife in the Basar area.

5. Compliance with Law and Event Rules

The Participant agrees to comply with all applicable laws and the Event’s rules and regulations as laid out by the Organizers. Any violation of such rules will result in immediate disqualification, and the Participant will forfeit any right to claims or refunds. The Participant acknowledges that the Organizers reserve the right to modify, postpone, or cancel the Event due to unforeseen circumstances, including weather or security concerns, and that no liability shall arise from such actions.

6. Consent to Medical Treatment

In the event of an emergency, the Participant consents to receiving medical treatment from authorized medical personnel, as deemed necessary by the Organizers. The Participant agrees to bear any costs associated with such treatment and holds the Organizers harmless from any liability or claims arising from medical care provided during the Event.

7. Photography and Media Consent

The Participant agrees that the Organizers may record, photograph, or otherwise capture the Event and the Participant’s participation. The Participant grants full rights to use such media for promotional, advertising, or any other purpose, without the need for additional compensation or consent.

8. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Republic of India, Any disputes or claims arising out of this agreement shall be subject to the exclusive jurisdiction of the courts in, India.

9. Entire Agreement

This Indemnity and Waiver Agreement constitutes the entire agreement between the Participant and the Organizers and supersedes any prior agreements or understandings, whether written or oral. Any amendments to this agreement must be made in writing and signed by both parties.
